seaBILL software is protected by US and International Copyright laws. Many people
do not understand that software normally is not purchased - its use is licensed.
This means that the software license purchaser is given the right to install the
licensed software program on one computer and retain a copy for archival purposes only.
Many people seem not to understand this fact and feel it is acceptable to make
multiple copies of software and install the copies on more than one computer. Unless this is specifically authorized by the owner of the copyright, such action is a violation of Federal Copyright law and can result in severe criminal penalties.
The problem is a big one for the software industry. According to the
Software & Information Industry Association's SPA Anti-Piracy Division:
"Piracy is a very serious problem. Conservative analysis estimates revenue lost to software piracy for business applications in the U.S. during 2004 was $6.6 billion. Worldwide, the loss is estimated at $11 billion or 4 out of every 10 copies being pirated."
"Microsoft Corp. is committed to the protection of intellectual property rights and to the reduction of software piracy worldwide. Product Activation technology is being included in Microsoft® Office XP, Visio® 2002 drawing and diagramming software, and Windows® XP operating system. This technology is aimed at reducing software piracy (the number of illegal copies of a product) as well as ensuring that Microsoft’s customers are receiving the product quality that they expect. The goal of Product Activation is to reduce a form of piracy known as "casual copying" or "softlifting." Casual copying is the sharing of software between people in a way that infringes on the software’s end user license agreement (EULA). An example of casual copying is if someone were to obtain a copy of Office XP and load it on his or her PC, then share it with a second person who loaded it on his or her PC, then share it with a third person who loaded it on his or her PC, and so on. This form of piracy is prevalent and has been estimated by some industry trade groups to account for a staggering 50 percent of the economic losses due to piracy. Worldwide, the piracy rate is estimated to be 37 percent; in other words, one out of every three software products in the market is pirated."Our experience supports these statistics. As a result, we have implemented a 'Password Protection' feature in our products. This feature requires a new password whenever a seaBILL program is installed. With this feature, a user of seaBILL programs will be prevented from violating the Federal Copyright laws and the terms of the seaBILL license agreement. This also has the benefit of preventing users of database products from attempting to 'mix and match' databases installed on different machines. Such practice is almost certain to cause data problems possibly resulting in the loss of some or all data and dramatically increasing technical support. The following is the latest version of the seaBILL Limited Use License Agreement that is applicable to all seaBILL software programs.
Limited Warranty - This product is warranted to perform substantially in accordance with the specifications in the accompanying documentation for a period of 90 days from the date of purchase. This limitation may not apply to you depending on local law.
Customer Remedies - seaBILL's entire liability and your exclusive remedy shall be, at the option of seaBILL, either return of the purchase price paid or repair or replacement of the product so long as the product has not been subjected to damage resulting from accident, abuse or misapplication and so long as the license agreement has not been violated. A copy of the purchase receipt/invoice is required to invoke these remedies. Replacement products are subject to the warranty for the remainder of the original term of the warranty or 30 days, whichever is longer.
NO OTHER WARRANTIES - TO THE MAXIMUM EXTENT PERMISSIBLE, SEABILL DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. YOUR RIGHTS MAY VARY DEPENDING ON LOCAL LAW.
NO LIABILITY FOR CONSEQUENTIAL DAMAGES - TO THE MAXIMUM EXTENT PERMISSIBLE, SEABILL SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE USE OR INABILITY TO USE THIS PRODUCT EVEN IF SEABILL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE ABOVE LIMITATION MAY NOT APPLY TO YOU DEPENDING ON LOCAL LAW.

Notice: If you purchase a product, the password you receive cannot be used for subsequent installations. You may be charged a fee, up to the amount of the current licensing fee for the applicable program, for subsequent passwords. The amount of the fee may be changed without notice. Any waiver of the fee by seaBILL shall not constitute a further waiver of such right to charge for passwords. Once the product is purchased and a password is issued, refunds will not be granted.
